After his arrest for alleged domestic assault, Rodney Atkins said he was left no choice but to file for divorce from his wife of over 13 years. TMZ has obtained the divorce documents, which include Tammy Atkins’ counter complaint and what both parties are seeking as part of their separation.

According to the court documents, Tammy Atkins wants sole custody of Elijah, the couple’s 10-year-old boy. She also is asking for alimony, child support and for her husband to pay her legal fees. Meanwhile, Rodney Atkins wants joint custody and for his wife to pay his legal fees. He is willing to pay child support.

The reason for the divorce is “irreconcilable differences.” Both parties state that the other is guilty of “such inappropriate marital conduct as renders further cohabitation unsafe and improper.”

While it appears this came on rather quickly — since the news just broke to the public today — documents were actually signed on both Nov. 22 and Dec. 5, 2011. The next step is for a judge to rule on Atkins’ motion to have his wife’s counter claim dismissed. Court documents show that this will be ruled upon on Dec. 20.
