You often hear that there is a difference between a "father" and a "daddy" because it's true, but what category does a "sperm donor" fall under?

Back in 2009, William Marotta responded to an ad on craigslist posted by a lesbian couple seeking a sperm donor, and they were willing to pay $50.  Mr. Marotta and his wife met with the couple, Angela Bauer, and Jennifer Schreiner, and decided to help the couple achieve their dream of being parents, and refused payment.

All parties signed a "sperm donor contract" that said Marotta would have no paternal rights and would be in no way responsible for any child that resulted from the donation. Bauer and Schreiner also agreed in the contract to indemnify William and hold him harmless for any child support payments demanded of him by any other person or entity, public or private, including any district attorney's office or other state or county agency, regardless of the circumstances, according to legal documents filed in the case.

The couple did get pregnant with the donation after artificially inseminating Schreiner and she gave birth to a baby.  Over the years, Marotta had heard talk that the couple had a baby but he had no contact with the child or it's parents. After the child was born, the couple had financial troubles and applied for state assistance to help with the child's healthcare.

The Kansas Department of Children and Families asked them the name of the father and said they wouldn't provide any assistance unless they provided the name. The women gave the state Marotta's name and on Oct. 3, attorney Mark McMillan filed a petition on behalf of the Department of Children and Families that claimed that Marotta was the baby's father and needed to support her. The filing said that the state had spent $189 on the baby from July 2012 to September 2012 and nearly $6,000 in medical assistance, which Marotta had a duty to pay.

Where things get fuzzy with Kansas law, is that Bauer and Schreiner did not use a licensed physician for the artificial insemination, so the state does not recognize their legal agreement, and they want Marotta to pay up...
